Civil society activists have gone to court to challenge the constitutionality of the recently launched hustler fund.

The applicant operating under operation Linda Ugatuzi has raised over 15 issues which he wants the court to address.

Some of the issues include, the manner in which the fund operates which they say has no known established office or entity.

The organization through Prof Fred Ogalla questions why Kenyans are being asked of their Mpesa PIN numbers to unknown entities adding that the fund has not been approved by the parliament.

“A fund of this nature has to be established by an Act of Parliament and the monies being dished to Kenyans must be contained in the financial budget,” Professor Ogolla said.

He says that in his petition at the high court that Kenyans need to be protected in receiving funds or monies whose sources should be revealed.

The applicant wants the court to order Hustler Fund to disclose the operation office, company and the list of directors.

He has also told Kenyans not to be under pressure to pay back the funds due to lack of legal frameworks and repayment term.

The petition will be placed before duty judge for directions.
