The Director of Public Prosecution Noordin Hajji has made an application to withdraw the murder case against Public Service and Gender cabinet Secretary Aisha Jumwa
The SC through his lawyers Danstan Omari and Shadrack Wambui sought review of the case after going through the evidence and the witness statement ballistic report and established there was no sufficient evidence to sustain the charges.
“We took our time and went through the evidence and witness statement and the ballistic test report and found out that there was not sufficient evidence linking Aisha with the murder either directly or indirectly,” said Wambui
The lawyer said that DPP has made a good decision since SC does not own a firearm which she could have used to kill the late Ngumbao Jola on 15th October 2019.
“The SC has no gun and has never owned an gun that she could have used to shoot the deceased ,the are are records for the firearm holders and her name is not in the list,” Omari urged.
The DPP commmunucated to court when the matter came up for mention at Mombasa law courts.
In the application filed by the prosecution Aisha Jumwa has been named to be in the list of state witness
