Chebukati Did Not Give Dissenting Commissioners Domestic Chores – IEBC Lawyers


The Independent Electoral and Boundaries Commission Chairman Wafula Chebukati has dismissed allegations before the court that he manhandled and denied other Commissioners their constitutional  role of tallying and  verification of the presidential election before announcement.

When answering questions raised by Supreme Court judges on the role of the IEBC Chairman at the Bomas of Kenya, IEBC lawyer George Murugu says that Chebukati performed his role as per Article 138 and never violated any law while performing his duties at Bomas.

Chebukati has been under fire for running the presidential election process with iron fist sidelining other Commissioners.

“There in my humble submission is a question of context and the checks for the Chairman we at article 138 which speaks for the checks and 138(c) speaks of tally and verification was and it was  fully satisfied nothing are further from the truth we saw commissioners interact with the results,” Muguru said.

“It is important to point out at this juncture that the 27 constituencies had been tallied and had gone verification process and were ready for announcement by professor Guliye my lords and my ladies I refer you to his affidavit…and to the circumstances why the chairperson opted to declare the results on the very day that he did the explanation be found of his affidavit. He made considerations concerning security of his staff who at that particular time were suffering arrests, abductions and injuries to officials including commissioners in his mind it was prudent to conclude the exercise since the article 138 C has been satisfied,” Murugu told the court.

According to IEBC lawyer Mahat Somane voters who were captured in the Kiems kits can be accounted for equally to those who voted manually and that the voter turnout should not be a matter before court.

“We have to look at all ballot boxes to get what are the exact stray ballot… We did analysis and we have two per polling station and we humbly want to donate a Kiems to court see what happens… Everything is captured in Kiems kit so how do we determine 50 plus 1…The turnout should not be an issue it just a matter of transparency,” Mahat said
