Comply With Court Order and Release Our Workers, Union Officials Tell NMS
Nairobi County government Workers Union now wants the Nairobi Metropolitan Service (NMS) to comply with a court order declaring the transfer of 6000 county workers illegal.
Speaking to Ghetto radio News the Unions’ secretary general Boniface Waweru says the process was unlawful as cited by the courts and that the Nairobi Public Service board is the only body mandated by law to handle county employees including hiring, transfer ,promotion and even dismissing workers.
‘‘We want the NMS to comply with the orders and release our workers from Public Service Commission.NMS itself has been declared illegal we want back our employees.’’ He said.
He further urged governor Mike Sonko to continue fighting for the rights of workers saying the deed of transfer was illegal and dead on arrival.
On Thursday the labour court declared the Deed of Transfer of Functions executed between the National Government and Nairobi City County Government as illegal and irregular.
Justice Hellen Wasilwa ruled that the deal was not approved by the County Assembly therefore making it unlawful further giving the state 90 days to regularize the same.
The court further declared the transfer of 6,000 county employees and the secondment of CEOs to the Nairobi Metropolitan Services (NMS) as irregular saying Nairobi Public Service Board was not consulted.
