CORD Loses Bid To Stop Matatu Case From Going On
The High Court has dismissed Cord’s application to dismiss a case in which a matatu operator wants compensation for a matatu burned during demonstrations against the IEBC.
Agnes Macharia, of Prime City Transporters Sacco, moved to Court after her 26-seater matatu valued at about Sh4 million was burnt by protesters.
Cord leaders Raila Odinga, Kalonzo Musyoka and Moses Wetang’ula filed an objection saying the court lacked the jurisdiction to hear and determine the matter.
But judge Joseph Onguto ruled on Monday that the court has jurisdiction as the applicants’ rights were violated and that Cord’s application was defective and amounted to an abuse of court process.
The case will be heard on June 29.
