Court Clears Nairobi Sub-County Liquor Committees, Chairs Ordered to Discharge Duties
The Employment and Labour Relations Court has allowed the operations of the new sub-county liquor committees that were formed by the then Acting Governor Benson Mutura.
According to Justice Nduma Nderi the court ought not to interfere with the appointments that were done by the relevant authorities.
This means that the respective sub county liquor committee Chairmen will continue discharging their duties.
‘‘That the application is frivolous and abuses of court process in that the tenure of the petitioners who were former members of the Nairobi City Sub-County Alcoholic Drinks Control and Licensing expired on 7th December, 2020….That there was never any appointment of the petitioners that was valid in the law and for that reason their name was never gazetted,’’ the ruling reads in part
‘‘The 1st 2nd and 3rd respondents appointed new members in terms of section of the Nairobi City County Alcoholic Drinks Control and Licensing Act 2014…That the Court ought not to interfere of an appointment duly made by the mandated authority,’’ It further reads.
The sub-county liquor committee chairpersons include Ms. Jane Wambui Ndegwa, for Starehe Sub-County, Caroline Wangechi for Mathare Sub-County, Nathan Nzomo for Lang’ata, Kamkunji by Boniface Kwasi Oloo and Michael Gachiri Waweru to head Kasarani sub-County committee.
Mr Thomas Kibiru will now head Makadara, George Maina Embakasi North, Aineah Ombima Newton Dagoretti North, Mercy Gatune Mutegi for Embakasi Central, Sylvia Awino Otieno Embakasi West ,Lucy Wanja Munene Embakasi East, Eddah Adede for Westlands, Oscar Otieno More for Ruaraka and Jackoniah Jung’a Onyango forKibra.
Two petitioners, Erick Kiongora Murigu and Stephen Mwangi, accused former Nairobi Acting Governor and Nairobi County Assembly Speaker Benson Mutura of breaching the contracts of the board members who were in office at the time he issued the notice.
“It is hereby ordered that pending the inter parties hearing and determination of this Application and Petition, conservatory orders be and are hereby issued suspending Gazette Notice No.86 of 12th January, 2021 announcing that the 2nd Respondent has appointed members of Nairobi City Sub-County Alcoholic Drinks and Licensing Committees,” initial court order read in part.
