COURT DISMISSES PETITION CHALLENGING ELECTION OF NGEI WARD MCA
The petition challenging the election of Redson Onyango as the member of the county assembly of Ngei ward in Mathare constituency has been dismissed.
Senior Principal Magistrate Robinson Ondieki said in his judgment that allegation of petitioner Kennedy Muoka of wiper party were not supported by way of evidence.
He said that the allegation that his agents were intimated, harassed and chased from the polling stations were not proved.
The trial magistrate disallowed the prayers seeking recount and scrutiny of the votes cast saying that the petitioner was not specific which polling station irregularities occurred.
“The petitioner should have pointed out in his pleadings from the 37 polling stations, which area agents were chased away or ballot papers were burnt,” the court observed.
The magistrate pointed out that the petitioner apart from making allegations ought to have included it in his pleadings for consideration by on whether to overturn the election of Redson Onyango.
The petitioner was ordered to pay IEBC and the winner Ksh. 500,000.
