The High Court in Nairobi last evening stopped the arrest and prosecution of Mombasa Governor Ali Hassan Joho and reinstated his firearms licences.
Justice George Odunga suspended Interior Cabinet Secretary Joseph Nkaiserry’s order revoking Joho’s firearms licences as well as confiscating his guns, pending determination of the application before the court.
The judge said Nkaiserry’s actions were illegal and in “excess of jurisdiction”.
The government cancelled Joho’s firearms certificates last week and ordered him to give up all his guns, failing which he was to be arrested by last evening because he was no longer a licensed firearms holder.
Joho had asked the court to order the reinstatement of his firearms certificates, arguing that his life was in danger and his rights had been violated.
Earlier, Cord leaders Raila Odinga and Kalonzo Musyoka threatened to storm the police station Joho would be taken to if he were arrested for not surrendering his firearms.
