The Director of Public Prosecution has lost bid to have the charges against the former Kenya Power boss Ben Chumo amended.
Trial magistrate Felix Kombo said in his ruling that already 33 witnesses have given their evidence and amending the charge sheet at this time will give the matter a fresh start.
“It is now four years since the accused persons were arraigned in court, and only five witnesses are remaining, to allow the stated amendments will take us back to four years,” said Kombo.
The prosecuting counsel told the court that they will be consulting the DPP on the way forward and that the case will be mentioned virtually on August 25th 2022.
Those charged with economic crimes alongside Chumo include former Managing Director Ken Tarus, Beatrice Meso, K.P. Mungai, Joshua Mutua, Abubakar Swaleh, Samuel Ndirangu, Stanley Mutwiri, Benson Muriithi, Peter Mwicigi and John Ombui.
Some of the charges include conspiracy to commit an offence, aiding the commission of a felony, willful failure to comply with procurement laws, conspiracy to defeat justice and fraudulent acquisition of public property.
