Embakasi East member of parliament Babu Owino and self proclaimed ghetto president Calvin Gaucho and six others have been finally been charged with offence of attempting to create insecurity of the country.
The accused persons were paraded before Magistrate Lucas Onyina at 5.pm and the prosecution the deputy director Jacinter Nyamosi and Joseph Irungu opposed the release of the accused persons on bond or bail.
They said that if the accused are release on bail they are li to interfere with the security of the country.
They urged the court to consider the activities of the court and order them remanded until the hearing and determination of their case.
However the defence counsels, Ndegwa Njiru,Duncan Okatch and Danstan Omari among others opposed the application by the prosecution on grounds that no compelling reasons was supplied to deny the accused persons’ right to bail.
They submitted that the accused persons arrested on 18th July 2023 were held in various police stations and were not give access to their lawyers or families.
” Your honour our clients were held in communicado nor were they given for food or water.” The la submitted.
The court was told that the section under which the accused have been charged does not disclose the offence under the law.
They took exception that MP Owino was arrested on July 18th at JKIA around 9 pm on arrival frome Mombasa and was whisked away and booked at Wang’uru Police in Kirinyaga County.
The lawyers urgued the court to consider the conduct of the DPP and DCI in handling the case faci their clients.
They said they have been brought to court after 24 hours outside mandatory period required by law.
As the Ghetto Radio was going on air at 7 pm the case was still proceeding on the argument over the bail application.
