Francis Mureithi takes Babu Owino to the Supreme Court


Embakasi East Parliamentary contestant on a Jubilee ticket has moved to court seeking the annulment of the re election of Babu Owino as the constituency’s MP.

Mureithi’s petition is among the 11 petitions the Supreme Court is handling from the 2017 August Elections.

The Court of Appeal in June 8 overulled High Court’s decision to nullify the Embakasi East election saying the reasons for the nullification were not founded in the law.

A status report released by the Judiciary indicates that seven of the petitions are of the governor’s post namely Wajir, Kirinyaga, Machakos, Kwale and Homabay.

Wajir and Machakos governor’s posts have two petitions each at the Supreme Court.

Three other petitions are for Members of the National Assembly namely, Embakasi East, Embakasi South and Eledama Ravine Constituencies.

One petition for Malindi senatorial seat is also at the Supreme Court.

According to the report a total of 77 petitions at the  Court of Appeal and High Court were dismissed upon ruling and judgement, 37 were allowed and 61 appeals still pending determination.

A total of 388 petitions emerging from the 2017 General elections were filed at the law court.
