The High has ordered the government to compensate the families of Garissa University University attack victims a global sum of ksh 470 million.

The three-judge bench ruled that the state failed in its responsibility to protect the victims from the eminent attack even after its security agencies received a security advisory.

The petitioners had intimated to the court that there was sufficient intelligence information that terrorists had earmarked the institutions, but the security agencies rubbished the information as 1st April Fools’ Day hoax.

The victims submitted that on the fateful day, the government deployed the elite recce squad to counter the attack two hours after the terrorists stuck.

According to the victims, delayed deployment of the Recce Squad was occasioned by the senior police boss, who had booked the same aircraft to lift his in-laws from Nairobi to Mombasa

The court heard that a week prior to the attack, a warning had been issued that terrorists were camping at a Mandera hotel, planning to attack no- muslims students in the university.

” The state failed in its responsibilities to protect citizens against terrorists …the state failed to meet the legitimate expectations of the petitioner.” The court ruled.

In the ruling court found the petitioners had successfully proved their case and against the government.

In the 2nd April 2015 attack over 140 students  were injured  by bullet of the terrorists.
