Gatundu North MP Wanjiku Kibe has lost her seat after the High Court ruled that she was not eligible to vie for the parliamentary seat as she was still an MCA during nominations.
High Court Judge Weldon Korir has ruled that Ms Kibe was not validly elected due to violation of election laws and has directed a fresh election in accordance with the law.
This means that if the decision of the High Court is not appealed, the Independent Electoral and Boundaries Commission will have to conduct fresh parliamentary elections so that voters can elect a new legislator.
In June this year the Court of Appeal had overturned the decision of the High Court to dismiss a petition challenging Kibe’s election.
However instead of nullifying the election, the Court of Appeal asked the High Court to handle the case afresh.
