Huduma Namba Case On, Lobby Trashes Withdrawal Claims

Katiba Institute and Nubians Right Forum have refuted claims doing rounds in the media platforms  that the two organizations have withdrawn Huduma Numba Appeal case Against the government.

Speaking to Ghetto Radio News Nubians Rights Forum chief Executive Officer Shafi Ali says the case is much alive  at Court of Appeal and and anything contrary is rumors  and should be dispelled at all cost.

“The Standard Newspaper reported that these lobby groups withdrew the case because it was taking too long but I want to say that those reports are not true and should be regarded as rumors.. We are alive in court of appeal and next week the Courts will give us direction on this matter,’’ Shafi said.

October last year High Court declared the roll out of Huduma Namba, illegal citing conflict with Data Protection Act as stipulated.

Justice Jairus Ngaah ruled that the government should have conducted impact assessment before rolling out the Huduma Cards. The Judge ordered the government to conduct the assessment before the rollout to safeguard people’s data.

“Order of mandamus is hereby issued compelling the government to conduct a data protection impact assessment in accordance with section 31 of the data protection act before processing of data and rolling out the huduma cards,” Judge Ngaah ordered.

In their argument Katiba Institute said High Court had ruled that processing of the National Integrated Identity Management System (NIIMS), including the processing of biometrics and data of children, implicates high risk to the rights of a data subject.

‘‘We are more energized and such propaganda will not deter as from pursuing the rights of our people …Many in this community do not have ID cards they can’t access that Huduma Namba ad that’s our argument,’’ Shafi told Ghetto Radio News.
