It is Not Yet Over for Convicted Karen MCA, Lawyer says

Legal experts now claim that Karen MCA David Mberia is not yet in trouble over his conviction on Ksh. 1.7 million bribery case since he still has the avenue to appeal the ruling.

According Constitutional lawyer Shadrack Wambui the constitution gives room for exhaustion of all legal avenues before the final decision can be made and that justice Mumbi Ngugi’s directive to have judgement served to the County Assembly speaker is still inconsequential.

‘‘Chapter 6 Article 75 is very clear on this but the same constitution still states that he should be given time and opportunity to exhaust all appeals up to the Supreme Court so he should not be sent home the moment unless he considers not to appeal to any court,’’ he said.

He however, warns that should Mberia fail to appeal then the consequences are directed and he will not hold any public office in future including losing his seat as an MCA for Karen Ward.

Mberia was convicted for receiving Ksh. 1.7 Million bribe in a land dispute in Pumwani, Kamukunji constituency.

Two other MCAs who were allegedly involved in the deal were acquitted after the prosecution failed to provide sufficient evidence in their involvement.
