The law on sharing explicit content
Offenders found guilty of sharing explicit content risk a two year jail term, a fine of Ksh. 200,000 or both.
Section 37 of the Computer Misuse and Cybercrimes Act states, “a person who transfers, publishes or disseminates, including making a digital depiction available for distribution or downloading through a telecommunications network or through any other means of transferring data to a computer, the intimate or obscene image of another person commits and offence and is liable on conviction to a fine not exceeding Ksh. 200,000 or imprisonment for a term not exceeding two years or to both.”
The warning from KFBC comes against a backdrop of uproar from women leaders in the country who claim that they are being targeted by the perpetrators.
Last week Suba North MP. Millicent Odhiambo proposed the amendment of the law seeking life imprisonment of the perpetrators.
