The advocates representing David Machiri Kimani,Equity Bank employee who allegedly swindled over ksh 1.5 billion now want the court to order police produce their clients.
A battery of lawyers led by Ndegwa Njiru informed the presiding magistrate Geoffrey Onsarigo that their client was illegally arrested after he was released on bond after recording statement with Directorate of Criminal Investigation.
Ndegwa says the police breach the police bond terms by arresting their client who was freed bond.
Machiri had been released on ksh 500000 and ordered to report at the DCI Headquarters every Tuesdays and Thursdays.
They say their client have been held in a communicado and that they have not contacted their client who family are now traumatised and fear for their kin’s life.
“Let the police produce our client by 2pm, the family is stressed and their is presumption that the police abducted our client” Ndegwa says.
They further submitted that the respondent’s wife Susan Wariga made a report of a missing person at kikuyu police station vide an OB 0512/8/24 but the police.
The lawyers say the police also arrested Muchiri’s father, placed buckets on his head, and fired towards his head to intimidate him.
According to the lawyers, the police had no justification to arrest the elderly father of the respondent.
They want the court order Inspector General of Police to produce Machiri by 2 pm weather dead or a life.
