A lobby group Civil Society Reference Group has now threatened to sue Nairobi County Government ward administrators should they not act on a petition to enhance public participation at ward levels.
According to Civil Society Reference Group Chairman David Caleb Otieno the County government has ignored the Constitution 2010 Article 10 on inclusive governance by not conducting proper public participation before role out of various projects.
He says the ongoing plans to have some areas demolished has not been inclusive and that people have been denied the right to participate fully in the said projects.
“We have issued the petition and more than 3 sub counties have received the communication. Those who have refused to take this and act upon it as stipulated in the constitution will meet us in Court.” He said while addressing the media after presentation of the petitions.
“You can imagine just recently Nairobi County Government officials together with the Assembly came to a public participation forum with an already drafted 65 million shillings Ward Development Fund.These are discrepancies that we shall allow to happen in this county. The rule of law must prevail.” He added.

Meanwhile they have called on the Nairobi Assembly to ensure that the County government of Nairobi implements the County government Public Participation Act of 2015 which states that the county must allocate 30% of its budget towards public participation.
”It is time for operationalizing the Act and we shall ensure that it is done so that public participation process can be well organized and enough people are accommodated not this joke of putting 7 people in a hall in the name of participation.” he added.
