Retired Chief Justice David Maraga has sued lawyer Ahmednassir Abdullahi for defamation.

Maraga says that social media post made by Abdullahi on bribery of a Supreme Court judge were intended to mean that he is not a decent Kenyan.

The tweet published in January 12, 2021 is according to Maraga libellous and scandalous.

The former Chief Justice has sued Abdullahi the the TrippleOKLaw advocates, LLP.

In the disputed tweet Abdullahi had asked Marga to come clean on the issue of a senior judge of the Supreme Court who allegedly took a bribe of Ksh. 220 Million.

“If CJ Maraga is a decent Kenyan, he should come clean on the issue of the SENIOR judge of the SUPREME COURT who took Sh220 million BRIBE. Me and CJ Maraga know the judge…intelligent Kenyans must read A LOT on Maraga’s astute silence on this matter!” stated Abdullahi.

Maraga argues that he is an elder at the SDA Church, a position that requires a person of high integrity and morals.

While describing the claims as false, justice Maraga says the lawyer did not lodge any complaint with the relevant authorities or initiate proceedings for the removal of the Supreme Court judge as required under the Constitution and the Judicial Service Act.

“Despite demand for an apology and an unequivocal public retraction, the defendant has declined and refused to pull down the Twitter post or to render an appropriate apology,” says justice Maraga.
