Embakasi East Member of Parliament Babu Owino, Calvin Gaucho and five others have been released on a cash bail of Ksh.100,000 each.
The MP and his co-accussed were charged in taking parts in subversive activities.
In ruling delivered by Chief Magistrate Lukas Onyina noted that the prosecution had not established sufficient reason to deny the accused persons bail.
The court also observed that the prosecution did specify the accused persons that would interfere with investigations or witnesses.
The five co-accusseds Tom Ondongo Ong’udi, Michael Otieno Omondi, Pascal Ouma, Kevin Wambo and Willys Owino Baraka were on Wednesday arrested on 18th July 2023 in various places.
Babu Owino was on Tuesday night arrested at the Jomo Kenyatta International Airport (JKIA) and taken to Wang’uru Police Station in Mwea, Kirinyaga County, ahead of the Wednesday protests by the Azimio coalition.
His legal team applied for his release, arguing that he had been unlawfully arrested and detained and that the charges preferred against him could not be substantiated.
The court further found and held that the criminal charge facing the accused persons if found guilty would attract a maximum of seven years in prison.
