Nairobi Assembly Adopts Report To Kick Out County Attorney
Nairobi County Assembly has resolved to kick out of office Nairobi County Attorney Lydia Kwamboka in a damning report that was tabled before the assembly by Sectorial committee on Justice and Legal.
Her removal was initiated by a petition from Bunge La Wananchi Chairman John Mark Ababu who accused Kwamboka of corruption, nepotism, tribalism among others.
The legal committee agreed with the accusations that recommended Kwamboka’s removal.
‘‘The Ag. Governor Nairobi City County, terminate forthwith the services of one Ms. Lydia Kwamboka as County Attorney in accordance with section 13 of the Office of the County Attorney Act 2020..and All instructions issued to the firm Njenga Maina and Company Advocates be withdrawn and given to internal advocates or a law firm that is pre-qualified to offer legal services to the county,’’ report read by the committee chair John Komu states.
It further accused the embattled attorney of not adhering to public procurement and asset disposal act as required by the law.
‘‘The County Attorney has contravened and variously flouted the provisions of the public procurement and asset disposal act 2015 through the issuance of instructions to unqualified law firm,’’ the report reads.
‘‘The conduct of the county attorney does not meet the provisions of Chapter 6 of the constitution of Kenya and the Leadership and Integrity Act 2012 and hence she is unfit to hold public office,’’ it further states in part.
The petitioner Johnnmark has now asked Kwamboka to vacate the office before he calls for demonstrations to eject her from office.
‘‘The assembly’s decision is very clear… Kananu should remove her very first from office because she failed to serve Nairobians in accordance with the law,’’ he said.
Meanwhile Speaker Benson Mutura in a communication has confirmed the adoption of the report and the ball is now in Kananus’ court.
