The transfer dispute between workers of Nairobi city county government and Nairobi Metropolitan Services is far from over as the workers are now threatening to go on strike should NMS withdraw payroll from Nairobi City County Government.
According to Nairobi City County Government Workers Union NMS is not their employer and transferring their payroll to NMS is an illegality.
They have protested the fruitful move made by NMS to have salaries of all the transferred workers under it.
‘‘They are not our employers and this has been made clear by courts so we can’t allow our members to be paid by an entity that its not recognised by the constitution,’’ Boniface Waweru the unions’ Secretary General told Ghetto Radio News.
The have called on the senate to regularise NMS and have their salaries paid directly by the treasury.
‘‘We want our money to be paid by the treasury because we are not going to accept anything from NMS. They are not our emplyers. They are not county public service board,’’ he added.
June this year, the labour court through Justice Hellen Wasilwa declared that the transfer of 6,000 county employees and secondment of CEOs to the Nairobi Metropolitan Services (NMS) as irregular and illegal since the Governor of Nairobi, Mike Sonko was not consulted.
She has therefore given the government 90 days to rectify the illegality failure to which any party will be at liberty to move the court for appropriate action.
The case had been filed by activist Okiya Omtata.
