Nairobi Leadership Takeover Is Against The Law, Constitutional Lawyer Warns

Attempts to have Ann Kananu Mwenda sworn in as the Nairobi County Governor continues to attract attention from legal experts with constitutional lawyers now accusing political bigwigs of controlling Cityhall and not following the law.
According Lawyer Shadrack Wambui the process followed to have Kananu act a City boss was rushed and did not meet the constitutional threshold.
‘’We should not be happy with what is happening at Cityhall because it’s clear that there is a click of individuals who are using their political powers to undermine the constitution. We have seen last week how Kananu was vetted in a very expedited and curious manner and what it is also true is that politics is operating against the law,’’ Wambui told Ghetto Radio News on Phone.
Yesterday High Court temporarily halted the swearing in of Mwenda as Nairobi County Governor pending the hearing of a petition filed by the Law Society of Kenya (LSK) and Kenya Human Rights Commission (KHRC).
The court has now directed that the matter be forwarded to the acting Chief Justice Philomena Mwilu who is expected to assign at least three judges to preside over the matter.
“Pending further orders of a multi bench and with the view of maintaining the prevailing status quo, a temporary injunction is hereby issued restraining the respondents, their agents and or servants from swearing in as Governor of Nairobi County pending hearing of the application,” reads the court order.
