Nakuru West Town MP Samuel Arama Jailed For 6 Months

Nakuru West town Member of Parliament Samuel Otara Arama has been jailed for six months after he was convicted for attempting to defraud a property in Nakuru.

However the court gave him an option of a fine of Ksh. 1,560,000.

Also sentenced by the trial magistrate Vincent Wakumile are three former land officers in Nakuru County namely, John Mwaura, Daniel Nyantika and Charles Birundu an ordained cleric.

They were also given an optional fine of Kshs 1,040,000.

The lawyer who acted on the transaction Kennedy Onkoba will serve the same period of six months in prison, or pay a fine of Ksh. 560,000.

The trial magistrate Vincent Wakumile while passing the sentence said all the accused persons did not directly benefit from the transaction and the subject title was returned to the complainant.

“The court understands that these are public servants and first time offenders. It is also in the public domain that the property was restored back to the complainant through the offence cannot go unpunished,” Magistrate Wakumile stated.

The trial court adopted the submission of the prosecuting counsel Joseph Irungu that it is being guided by the sentencing policy guidelines developed by the judiciary in meting out the sentence.

Defence counsel led by Dr. Ken Nyaundi pleaded to the court to consider lenient non-custodial sentence stating that the first accused person’s retirement has been interrupted leading development of high-blood pressure.

“It is worth to consider in its  entirety, that the member of parliament has dependents who he supports  in education  among  other needs. He is a first time offender and we request that the leniency be applied in his sentencing,” Dr. Nyaundi pleaded on behalf of the convicted persons
