Two members of Nairobi County Assembly and County employees have been arraigned in court

The office of DCI is seeking to hold the suspects for a period of 14 day to enable the investigating officers complete investigations in relation to respondents having been arrested while possession of a firearm with licence

The Ngei ward MCA Redson Onyango and Mabatini’s Wilfred Odalo were arrested together with their two personal assistant Erick and Antony Otsyula on 18th Kuche Kuche restaurant.

The prosecution told trial magistrate Ben Mark Ekhubi that police want to establish the validity of the firearm licence and the meeting they had at the restaurant prior to protects called by Azimio and its coalition partners.

However the application for custodial was strongly opposed by defence cousel led by Samson Nyaberi on grounds that their clients have been held beyond the 24 hours mandatory period required by law.

The lawyers told court that the police did not asked their clients the certificate of the said firearm before putting them in police custody.

They said the police do not need the respondents in their custody while seeking to establish the validity of the firearm licence.

“The MCA their personal assistants and two employees of Nairobi County have a fixed abode and therefore are not at flight risk” Lawyer Samson Nyaberi told court.

However considering the weighty issues raised by both investigating officer and the respondents’ lawyer, the court reserved its ruling for tomorrow, Friday 21st.
