Sirisia MP John Waluke To Serve 67 Year Jail Term Over Graft

Sirisia Member of Parliament John Waluke has lost an appeal he had filed in court to have the judgement of the lower court set aside a ruling in which he was sentenced to 67 years in jail.

Waluke and his co-appellant Grace Wakhungu will serve the 67 and 79 year sentences respectively as pronounced by Magistrate Elizabeth.

Justice Esther Maina in her judgement said that the sentence was not harsh since the two  had defrauded the government shs. 297 million in the supply of maize to the national cereals and produce board.

“I find that the sentences were not excessive. They are within the law. Therefore the conviction and sentences are affirmed,” the judge ruled.

The court found that the evidence tendered before by the prosecution was factual, which showed that the appellants had fraudulently received the money.

The court gave the two the option of a fine of a total of shs 2 Billion.

In rebuttal Waluke through lawyer Elisha Ongoya told Justice Maina that the Ksh.313 million payout was lawful after an arbitrator ruled in favour of their company  Erad Supplies Limited.
