Building bridges Initiative appeal case continues today with lawyer Otiende Amollo taking issue with the High Court judgement that declared the process illegal null and void.
According to Otiende the promoters of the BBI were Dennis Waweru and Junet Mohammed and not the President Uhuru Kenyatta as cited in the judgement.
In his submission Otiende says the presidential role was ceremonial and had nothing to do with constitutional process of coming up with the BBI bill.
“The judges ignored all evidence that promoters were Dennis Waweru and Junet Mohammed. How do you ignore such?’’ he posed.
“A popular initiative starts at a point the idea is muted and then converted to a bill …same two gentlemen Dennis and Junet wrote to IEBC asking for guidance in an affidavit and as promoters … IEBC then gave them go ahead to collect signatures,” Otiende told the seven judge bench.
IEBC lawyers led by former Attorney General Githu Muigai will also issue their submission today.
The seven judge bench is guided by Court of Appeal president Daniel Musinga.
