Woman In legal battle With Nephew Over Dagoretti Property

A woman is in a legal battle with her nephew over property located in Dagoretti and Uthiru area in Nairobi  County.

The complainant Roul Muchene claims that her auntie  Rachel  Nduta has taken over the estate of his late father  and she has refused  to vacate  the matrimonial  home and settle  in a land where  she was allocated.

Muchene through  his lawyers  Danstan  Omari and Omayio  Aranga told justice  Ogutu  Mboya that Nduta  had no legal documents allowing her to occupy the first  estate  of the late Muchene.

“After  you  are married, and came back after  your  marriage  failed, you are only accepted as a daughter, but you are not entitled to any property,” Omari said.

Nduta during the hearing admitted  that she has no written  agreement  permitting  her to occupy  matrimonial  home, stating that her late father only communicated verbally to her two other siblings.

“We had an exclusive conversation with my late father and my other two siblings, it is during that time that he gave me part of his vast estate,”Nduta argued.

The court  heard that Nduta  took advantage  of Muchene  having  been  outside  the country for quite  number  of years  and took possession of the estate.

Nduta  had been  previously  married  before  her marriage  broke  down  and opted  to return to her matrimonial home.
