A 34-year-old woman who exposed her 10-year-old daughter’s nude photos to a foreign man promising to have a three-some with the man and daughter has been charged before a Mombasa Law Court.
The woman shared her daughter’s nude photos with Zohair Al Mukaram with the promise that they would have a threesome. The court further heard that the said Al Mukaram, who was due to fly into the country this month, would have sex with the accused and her daughter.
Mutuku heard the woman intentionally and unlawfully possessed her daughter’s obscene images on her mobile phone for pornography reasons.
She told Mutuku that she was confused when the charges were read to her for the first time. She is facing a second count of child pornography contrary to section 24 (1) of the Computer Misuse and Cybercrime Act after she was allegedly found with obscene images on her mobile phone.
The matter will be mentioned on October 31.
What the Law Says
Children Act, 2022 prohibits the following.
| …. exposure of a child to emotionally, traumatic and age-inappropriate content, information and photos of any kind; | |
| (f) | engaging a child in child sex tourism and child trafficking; |
| (g) | the employment, use, persuasion, inducement, enticement or coercion of a child to engage in, or assist any other person to engage in, any sexually explicit conduct or simulation of such conduct; |
| (h) | the use or exposure of a child in, electronic or online, platforms for purposes of prostitution, pornography or any other unlawful sexual practice; |
| (i) | the use of a child’s images for purposes of pornography or sexual gratification; |
| (j) | dissemination to a child of any material, information, education or health services that promotes, induces, condones, or normalizes sexual activity or behaviour among children or with children; or |
