A high court sitting in Milimani has dismissed a petition challenging the Competency-Based Curriculum (CBC), which replaced the 8-4-4 education system.

The petition was filed by former LSk president Nelson.

The three-judge bench led by Hedwig Ongundi, Antony Ndung’u, and Antony Ndung’u said that the rights of the children will be offended.

“The best interest of the child is paramount consideration a court must do everything to preserve the rights of the minor,”court noted

The judges further noted that the timing of the filing was imperative in the determination of the application filed by the petitioner.

Justice John Chigiti ruled that although there was no constitutional timely on the filing of the petition,the petitioner moved to court two years after the implementation with any document to explain the delayed filing.

Jigiti further ruled that the government had invested taxpayers money into the construction of the classrooms, training of the teachers to retool them

the court found that scraping off the CBC would lead to waste of taxpayers’ money and loss of the jobs
