A day after President William Ruto  announced the commencement  of the PBO Act , section of  pressure groups led by Civil Society Reference Group are now calling for immediate engagement with government on implementation.

According to CSRG president Cidi Otieno  there are some section that are  not in line with government structure and need to be aligned for effective implementation.

He avers that the process should be inclusive a move he say will ensure smooth implementation process of the act.

‘‘Based on this, we oppose implementation of provision allowing automatic transition of the NGOs Coordination Board to the PBO Authority; automatic transition of the NGO Council to PBO Federation; automatic transition of Executive Director under the current NGO Act to be Executive Director under the PBO Act as they have been in office illegally and their automatic transition goes against the goal of the PBO Act 2013 which is to provide a new legal, regulatory and institutional framework for Public Benefits Organizations (PBOs) in Kenya.’’Cidi said.

 

The CSRG Demands the Following

  1. Immediate setting up a Joint Stakeholders Consultative Forum bringing together all stakeholders including PBOs to develop Regulations for the Operationalization of the PBO Act as provided for under section 69 of the PBO Act
  2. Immediate appointment of a new authority as provided for under section 35 of the Act in consultation with all the stakeholders concerned based on the provisions of the Third Schedule and ensuring that the process of appointing them is inclusive and competitive
  3. Immediate appointment of a new Director be as provided for under section 45 of the Act and in consultation with all the stakeholders concerned based on the provisions of the Third Schedule and ensuring that the process of appointing them is inclusive and competitive
  4. Immediate establishment of the PBO Tribunal as provided for under section 50 of the Act in consultation with all the stakeholders concerned based on the provisions of the Third Schedule and ensuring that the process of appointing them is inclusive and competitive
