President William Ruto has pardoned former Kenya Medical Research Institute (KEMRI) Director Davy Koech who was serving a six year sentence this is after being found guilty of corruptly obtaining 19.3 million shillings.

The Presidential pardon was issued in a gazette notice dated 21st July 2023.

Davy Koech’s case dates back to September 2021 when he was convicted by trial magistrate Victor Wakumile on three counts of unlawfully transferring research funds from KEMRI’s account at Standard Chartered Bank’s Kisumu branch to an account with the same bank at Yaya Center in Nairobi.

Additionally, Koech was accused of unlawfully transferring 342 million shillings belonging to KEMRI’s pension fund.

While delivering his ruling then, the magistrate said that he was not going to allow the 70 year old accused to be subjected to cruel treatment by being handed over to the prison authorities.

“Because of the current Covid-19 pandemic this court takes judicial notice of the difficult economic times people are undergoing through I find it fit to exercise my discretion and show mercy to Koech, who is now 70,”

Wakumile said while delivering his Judgment.

But he changed his mind after the accused failed to pay fine he imposed on him.

“Having given Koech more time to pay the fine in two tranches of Ksh 9.6 million to avoid going to jail, he has not complied with orders. I therefore order him to start his jail term from today,”

Petty Offenders

The former KEMRI director, who had been in his position from 1986 until his suspension in 2007 to allow investigations, had faced severe allegations of embezzlement and corruption during his tenure.

The President has also pardoned thousands of other offenders, 2944 petty offenders and 2117 long term offenders.
